The terms "we", "us", and "our" refer to Flick & Puff. These Terms govern your access to and use of our website, online store, and related services (collectively, the "Services"), which are intended for consumers located within the European Union.

The term "you" refers to the customer or user of our Services.

All content and information on our website are provided for personal and non-commercial use only.

1. General Information

We operate an online store offering cozy lifestyle and home products produced through print-on-demand manufacturing partners. Our Services are intended solely for individual consumers located within the European Union and for personal, non-commercial use.

You may use our Services only for lawful purposes. Any illegal, unauthorized, or harmful use is strictly prohibited.

By placing an order, you confirm that you are at least 18 years old and legally capable of entering into contracts under the laws of your country of residence.

We may update these Terms from time to time to reflect legal, technical, or operational changes. Any updates will apply only to future transactions and will not affect orders already placed. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms. In the event of any inconsistency between translated versions, the English version shall prevail.

2. Our Relationship with Shopify

Flick & Puff is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our online store are made directly with Flick & Puff.

Flick & Puff is the responsible seller of record for all purchases made through our online store. We oversee product quality, delivery, and customer support in cooperation with our trusted fulfillment partners.

3. Our Products

All products are made to order and produced individually after you place your order.

Please note the following:

• Slight variations in colour, size, or print position may occur due to production processes and screen display differences. These are not defects;
• Product descriptions, images, and prices are provided for guidance only and do not constitute a guarantee or warranty. They may be updated without notice;
• Products are intended for personal, non-commercial use only;
• We reserve the right to limit product quantities or discontinue items at any time.

Production is carried out in cooperation with our trusted print-on-demand partner (e.g., Printful), but Flick & Puff remains responsible as the seller of record.

4. Accounts & User Responsibilities

Creating a Flick & Puff account is optional but recommended for a faster shopping experience. We offer two types of accounts:

• Sign in with a one-time code sent to your email;
• Account creation with email and password.

You must ensure that all account information is accurate and kept up to date. You are responsible for all activities under your account, including orders placed and information submitted.

You may delete your account at any time by contacting us at team@flickandpuff.com. We will process your request promptly.

5. Prices & Payment

• All prices are displayed in euros (EUR) and include Value Added Tax (VAT), where applicable;
• Shipping costs will be clearly shown during checkout before you confirm your order. The total amount includes all applicable taxes and delivery charges;
• Payment must be made in full at the time of purchase. We accept secure payments through authorized payment providers. Payment method availability may vary depending on your country;
• Flick & Puff does not store or have access to your full card details. All transactions are processed securely in compliance with applicable regulations;
• We reserve the right to cancel or refuse any order if payment fails, is unauthorized, or appears fraudulent. You will be notified promptly.

6. Order Processing & Delivery

Orders are automatically sent to our production partners once confirmed. Each product is produced and shipped individually. Estimated delivery times are provided for your convenience and guidance only. Actual delivery may vary due to:

• Production volume;
• Destination country;
• Carrier delays, customs inspections, or other third-party handling;
• External factors beyond our control (e.g., weather, strikes).

Flick & Puff remains responsible for your order until it is delivered to the address you provided. Ownership and risk of loss transfer to you upon delivery.

While delays or issues caused by third parties may occur, we remain committed to ensuring that you receive your order. Please inspect your items upon receipt. If there are any defects, damage, or errors, contact us following our Refund & Returns Policy. We will assist you in arranging a replacement, repair, or refund, as applicable.

7. Cancellations, Returns & Refunds

If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason.

However, certain exclusions apply, such as personalised or custom-made items.

8. Limitations of Liability

We strive to provide high-quality products and a smooth shopping experience. To the fullest extent permitted by law, Flick & Puff shall not be liable for:

• Any indirect, incidental, or consequential losses, including but not limited to loss of profit, data, business opportunities, or goodwill;
• Minor variations in colour, size, or texture resulting from print-on-demand production processes;
• Delays in delivery, customs inspections, or handling by carriers and other third parties;
• Damage, defects, or issues resulting from misuse, improper care, or unauthorized modification of the product, or inaccurate information provided by the customer;
• Unlawful, fraudulent, or unauthorized use of our Services.

Flick & Puff's maximum liability for any claim related to an order shall be limited to the total price paid for that order, except where stricter liability applies under mandatory law.

These limitations do not affect your statutory rights under European Union law, including your right to withdrawal, replacement, repair, or refund for faulty or non-conforming goods.

9. Intellectual Property

All content available on this website, including designs, text, graphics, photos, and logos, is the property of Flick & Puff or its licensors and is protected by copyright law. You may not reproduce, copy, or use our content for commercial purposes without prior written consent.

When you submit your own material (such as customisation requests or personal text), you confirm that:

• You have all necessary rights to use that material and it does not infringe third-party intellectual property rights;
• You grant Flick & Puff a non-exclusive, royalty-free licence to produce and deliver goods based on it, solely for the purpose of fulfilling your order.

You acknowledge and agree that you are fully responsible for any claims, losses, or damages resulting from material you provide that infringes third-party rights. Flick & Puff reserves the right to refuse, modify, or remove any submitted material that it considers inappropriate or infringing.

10. Privacy & Data Protection

We take your privacy seriously and handle your personal data in accordance with the General Data Protection Regulation (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).

Flick & Puff acts as the Data Controller and determines the purposes and means of processing your personal data, including for order processing, payment management, customer support, order delivery, website analytics, and marketing communications (only with your consent).

Certain processing operations are carried out by our trusted partners who act as Data Processors on our behalf – such as Shopify (e-commerce and hosting), Printful (order fulfillment), authorized payment processors, carriers and logistics partners for order delivery, and Google Analytics (website analytics). These partners process personal data strictly under our instructions and in compliance with GDPR.

Some third-party providers, such as social media or advertising platforms, may act as independent Data Controllers for their own networks. Their processing practices are governed by their respective privacy policies.

11. Cookies & Analytics

We use cookies and similar tracking technologies to enhance your browsing experience, personalize content, and analyze website traffic. Non-essential cookies (such as analytics or marketing cookies) are only activated after you provide your consent through the cookie banner.

12. Indemnification

You agree to indemnify and hold harmless Flick & Puff, its owners, employees, and affiliates from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your misuse of our Services, breach of these Terms, or violation of any applicable law or third-party rights.

This indemnification does not limit or affect your statutory rights under European Union law, including rights related to defective or non-conforming goods.

13. Governing Law & Dispute Resolution

These Terms and any disputes arising from or relating to them shall be governed by the laws of Spain, without affecting your statutory rights as a consumer under European Union law.

Flick & Puff is not obliged or committed to participate in formal ADR proceedings before consumer arbitration bodies, but we will always consider reasonable requests to resolve matters amicably.
